【はじめに】 これから４回連載の予定で、無罪が確定した名古屋地判２０２３年１０月２５日を紹介する。巷では「融資金名目詐欺」という表現で報道されていたりする事案である。 結論から先に述べると、この事件には次の４点で、歴史に残されるべき価値がある。 １．自称被害者ら事件関係者に対しても、漫然と証拠の取捨選択を許すのではなく、スマートフォンデータを提出させるなど客観性のある捜査が欠かせないことが明らかになったこと。 ２．自称被害者らの証言後、その偽証を裏付ける客観証拠を入手したにもかかわらず、検察官がこれを隠したまま有罪論告を行ったという不祥事が判明したこと。 ３．裁判所が、客観事実に反する証言（意図的な偽証）の信用性を認めた事例であること（しかも関連する民事事件と合わせて裁判所は二度も間違えた）。 ４．上記２の不祥事、上記３の不見識について、検察庁や裁判所の自覚、自浄は凡そ期待できそうにも無い
