証拠に基づかず、印象で裁判を行うことは、当然、許されない。 しかし、印象で形成された心証が、こじつけた論理で糊塗された～或いは、そのようなこじつけすらせず、そのまま結論とされた誤判は多い。 本欄でも、そのような手合いは何度となく批判している。 さきほど書き上げた特別抗告も、そのような例に属する一つである。 事案は、類型証拠の裁定請求案件である。 検号証の「ＬＩＮＥ履歴一覧」が編集加工されていることから、原データと突合するためにスマートフォンの複製データの開示を求めたところ、「担当警察官が異動時に削除した」というのである。 私物のゴミ片付け宜しく、スマートフォンの複製データを削除していく警察官がいるということ自体が信じられないのであるが、名古屋地裁決定（藤根桃世裁判官）、名古屋高裁決定（杉山慎治裁判長ら）が何れもこれを信用し、かつ、保管要領の確認や反対尋問も不必要としたのだから、二度三度、驚
