コンビニエンスストア大手、ファミリーマート(東京)加盟店の元オーナー男性(46)が、一方的にフランチャイズ(FC)契約を切られたのは不当とし、近くファミマに対し契約解除の無効確認や損害賠償を求める訴訟を起こす。男性側によると、ファミマ社員による経理上の不正処理を男性が見つけ、責任追及したことが契約解除の背景にあるという。 関係者によると、不正処理をしていたのは、平成26年5月まで東京都多摩地区で加盟店の指導にあたるスーパーバイザー(SV)職にあった男性社員。 この社員は担当する加盟店の在庫だったギフト券「クオカード」を持ち出し、帳簿上は別の加盟店の在庫に移すなどし、不正にクオカードを取得。損害分は加盟店側の「営業雑費」として計上し、店側に負担させていた。 不正に気づいた加盟店オーナーの指摘で、ファミマが調査を実施。この社員による不正処理で、6店に計55万9千円の被害が出ていたことが判
コンビニエンスストア最大手「セブン―イレブン・ジャパン」(東京)の加盟店の元経営者が、値下げ販売を不当に制限されるなどして損害を受けたとして、同社に約2600万円の支払いを求めた訴訟の判決が15日、福岡地裁であった。 田中哲郎裁判長は「会社が値下げをやめるよう指導した行為は、販売価格の自由な決定を拘束し、独占禁止法違反にあたる」と原告側の請求を一部認め、同社に220万円の支払いを命じた。原告側の代理人弁護士によると、同社の値下げ制限行為を違法と判断し、賠償を命じたのは初めてという。 判決によると、元経営者は同社とフランチャイズ契約を結び、1997年から2008年まで福岡市内で加盟店を経営。04年、弁当などの値下げ販売開始を同社に通知したところ、担当者からやめるよう指導された。 05年には一部の商品でクーポンなどを利用した値下げを始めたが、同社側は、契約解除など不利益な取り扱いを示唆したとい
