    たまに「当社はxxxに関する特許を出願（あるいは取得）しました」というプレスリリースを行なう会社があります。特許を出願・取得したことを発表しなければいけない義務はありませんが、権利の取得あるいはその可能性について世の中に広く知らせるのは特許制度の目的にもかなっています（特許法には自社の特許を使用している製品にはその番号の表示を行なうべきという訓示規定があります）。 こういう発表があると、将来的に差し止めや損害賠償請求等の権利行使を受けるリスクを負う競合他社はやっかいな立場に置かれます（とは言え、いきなり権利行使されるよりも、事前に発表してくれるのはありがたいとも言えます。） 以下、パターン別に競合他社の立場から取り得る対策についてまとめてみます。 パターン１．特許出願したという事実のみの発表（出願番号なし） ある分野で特許出願したという事実だけが発表されて出願番号も示されていないケースです
