憲法解釈、答弁に窮する官房長官＝法制局長官「外し」で支障−衆院予算委 憲法解釈、答弁に窮する官房長官＝法制局長官「外し」で支障−衆院予算委 ２１日午後の衆院予算委員会で、自民党の谷垣禎一総裁が天皇陛下の行為にかかわる憲法解釈について質問し、平野博文官房長官が答弁に窮する場面があった。政府は今国会から、「政治主導」の一環として、内閣法制局長官に答弁をさせない方針だが、谷垣氏は「法制局長官を使ったらどうか」と求めた。 谷垣氏は、昨年１２月の天皇陛下と習近平中国国家副主席との特例会見問題を取り上げ、「天皇陛下は国事行為に拒否権がないというのが憲法上確立した解釈だが、公的行為はどうか」とただした。だが、平野長官は答弁できず、「法律的観点で答えないといけないので、後刻お答えする」と述べた。 このため、谷垣氏は「政治家が答えた方がきちんと答えられる問題と、法制局長官が整理した方が先に進みやすい問題
