大昔に書いた エミュ鯖送検の話について に最近進捗があって、それで昔のブコメとか読んでて思ったんですが 「法律が明文化されてないので運用でカバーとか駄目絶対」みたいなことを言いがちな人が多いのですが（そしてそういう人は日本の法律ダメ絶対みたいな意見であることが多い）、例えばイギリスとか憲法が明文化されてないわけです。 そもそもあらゆるパターンを想定して明文化された法律を書くなどということは不可能なわけです。プログラマーの皆さんならよく分かると思いますが例外的ケースを全てテストに記述することはだいたい不可能で、それをやるにだいたい等しい証明駆動開発など実用的なプロダクトではまあまず利用されないわけです。 なので例外的ケースとか想定してなかったケースとかは運用でなんとかするしかないわけで、ようは判例でなんとかしていくというわけです。英米法の体系を持つ日本にあっては上級審の判例というのは比較的強
