１．はじめに 本報告は、いわゆるWrongful life訴訟が惹起する問題群について、できるだけ広範に、かつ、できるだけ原理的な水準で考察することをめざすものである。それは直接には、差別、自己決定権、遺伝決定論といった主題に照準する作業であるが、それにとどまらない多様な含意が行論に見出されることを願っている。 ２．Wrongful lifeという概念について Wrongful life訴訟とは「子が先天性障害を持って出生した場合に（……）子自身が、医師の過失がなければ、障害を伴う自分の出生は回避できたはずである、と主張して提起する損害賠償請求訴訟」を指す（丸山英二［1995］）。ここで言う「医師の過失」とは、多くの場合、通常の医療過誤事件のように医師が患者を傷つけたことを指すのではなく、先天性障害のある子の誕生する可能性についての正確な情報を医師が親に告げなかったために、避妊や中絶によっ
