『公共性の構造転換』(Strukturwandel der Öffentlichkeit)とはドイツの哲学者ユルゲン・ハーバーマスによる公共性理論の著作である。ドイツ語の原著は1962年刊。 政治は常に公共性において営まれ、あるいは論じられる。政治とは公共性であり、公共事業や公務員はすべて公益を実現するものであり、政治は安全保障からインフラストラクチャーの整備、環境政策などの公共政策を決定するものと考えられる。そこにはそもそも公共性とは何かという問題が認められる。ハーバーマスは本書でこの問題を取り扱っており、序言の言葉を借りればこれは「市民的公共性」という類型に関する研究となっている。本書で採用されている方法は社会学と歴史学の方法を総合したものとなっている。つまり、市民的な公共性の構造がどのように成立し、どのように変容しているかを明らかにしようと試みている。本書は内容は第1章序論、第2章公

きのうの記事がわかりにくかったようなので、少し補足しておこう。「基本的人権」を信じる人にとっては、人権を売買するというのは許しがたい発想だろうが、そんな不可侵の重大な権利が「生まれながらに万人に等しく与えられている」というのは、根拠のない迷信である。そもそもこれは事実の記述なのか価値判断なのかも不明だ。 事実としては人が遺伝的に人権を持って生まれてこないことは明らかなので、これは「政府が人々に人権を与えるべきだ」という価値判断だろう。しかし生まれた瞬間に、すべての人に同じ権利を政府が賦与すべきだという根拠はどこにあるのだろうか。こうした自然権の概念の欠陥を最初に指摘したのは、エドマンド・バークである:私は、各個人が国家の運営において持つべき権限、権威、指揮などを文明社会内の人間の本源的直接的な権利に数えることを拒否する。私の考察対象は文明社会の人間であって、これは慣習(conventio

別に関係の無い話として読んでもらってかまわないのですが、「○○思想(体制)が生み出した犠牲者は××人である。だから○○はロクなもんじゃない」という論法への違和感について。 もちろん、虐殺という結果にいたった思想や体制はまったく擁護できないし、それは失敗であったと言わなければいけないと思います。しかしです。こうした議論の帰結は「だから○○思想を持ってるやつはロクなやつじゃない。反省せよ」になることが多くて、それにはとてつもなく違和感を覚えてしまうのです。え?それその思想を支持している人だけの問題なの?ということです。いやもちろん、その思想に対するつじつまを持ってない人はつける必要は無いわけですが、そうした思想が社会に浸透することを問題化するならば、誰もが責任が無い傍観者ではいられなくなるのです。つまり、ある思想のもとで多くの虐殺が起こっているならば、それは思想そのものに虐殺を引き起こしうる内
二〇〇七年九月二二日22:07 カテゴリ国家について 基本的人権と臣民の権利 最近更新が滞っておりました。お詫び申し上げます。もう少しの間更新が遅くなりそうです。 時々大日本帝国憲法と日本国憲法の比較で、「大日本帝国憲法は臣民の権利しか保障していないけど日本国憲法は基本的人権を保障している。だから日本国憲法のほうが優れている」という言説が見られる。特に学校での授業でそういうことが行われているようだ。しかしこの言い方は明確に間違っている。それは人権概念の成立史を見れば明らかなはずなのだが、政治家も「自由と民主主義、人権の人類普遍の原理」なるものがあると信じている。それが安倍政権であり、端的に言えば親米保守という連中だ。だがこの無学な連中に引導を渡すためにも、基本的人権とは何か、明らかにしておかなくてはならない。 基本的人権と言うが、何が「基本的」なのか。これすら答えられない者も多い。答えは「
