「辞めたら損害賠償請求してやる」という脅し文句を使って退職妨害をする会社はよく見聞きする。実際に請求される事案は稀なのだが、その損害賠償請求自体が不当訴訟であるとして、逆に損害賠償義務を負わせた裁判例がある。本稿は弁護士の明石順平氏が、そんな珍しい裁判例（横浜地裁平成29年3月20日判決）を知見をもとに解説する。 「辞めたら損害賠償」を実行した実例 労働者であるAさんは、双極性障害を理由に退職した。これに対し、会社は、双極性障害が退職のためについた嘘であった上に、就業規則に違反して業務の引継ぎを行わなかったとして、1,270万5,144円もの損害賠償を求める訴訟を起こしたのである。 Aさん側は、この損害賠償請求自体が不法行為であり、精神的損害を被ったとして、逆に会社側に対し、330万円を求める反訴を提起した。裁判所は、会社の請求は棄却し、逆に会社に対し、Aさんへ110万円を支払うよう命じる
